- The mobile application (the Life I live App) and the Services made available through the Life I live App is created and controlled by Life I Live Pty Ltd (ACN 683 650 231) (we, us or our).
- We are committed to ensuring your Personal Information is protected. We manage your personal information in accordance with the Australian Privacy Principles set out in the Privacy Act 1988 (Cth) (Privacy Act).
- By accessing and using our Life I live App and our Services you agree to this Privacy Policy.
- This Privacy Policy outlines how we collect, store, use and disclose your Personal Information, and how you may access your Personal Information kept by us or how you may make a privacy complaint.
- The information we collect about you
- Personal information has the same meaning that it has under the Privacy Act, namely, information or an opinion about an identified individual or an individual who is reasonably identifiable, whether the information or opinion is true or not and recorded in a material form or not.
- We will only collect and hold Personal Information about you that is reasonably necessary to undertake our business activities and functions, deliver the Life I live App and Services to you, or as otherwise permitted by law.
- The type of Personal Information that we collect and use depends on the type of dealings that you have with us and includes the following:
- contact details of the account holder and authorised users (for example, full name and email address);
- account credentials of the account holder and authorised users (for example, your username and password created by you as a user of the Life I live App);
- any memories, content, information and other data that account holders post, upload or publish on, or via, the Life I live App (including, but not limited to, journal entries, photographs, videos, voice recordings, text entries and other documents);
- information relating to the authorised users who have been invited to access the memories, content, information and other data of an account holder on, or via, Life I live App;
- your dealings, or enquiries you have made, with us, including information about the Life I live App and our Services;
- device information which is automatically collected from you when you visit and navigate through the Life I Live App. Such information may include, but is not limited to, your device type; your device’s network connections; unique device identifier, your device’s name; your device IP address, screen size and calibration, information about your device’s web browser and internet connection you use to access the Life I live App, geolocation information, browser characteristics, device characteristics, operating system and language preferences, dates and times of visits to the Life I live App and other usage statistics; and
- other information that you provide to us or that we may collect in the course of our relationship with you.
- Sensitive Information has the same meaning that it has under the Privacy Act, namely, information or opinions about your health, political affiliations, sexual preferences, religious beliefs, racial or ethnic origin, criminal history or other such private information.
- We do not intentionally collect Sensitive Information from account holders or authorised users. However:
- some of our services are automated and we may not recognise that you have accidentally provided us with Sensitive Information; or
- an account holder may publish, upload or post information onto their user profile which contains Sensitive Information.
- If you have accidentally sent us Sensitive Information and you wish to delete it, please contact us using the details in section 13 below.
- How we collect Personal Information
- We will collect Personal Information and Non-Personal Information about you in a number of different ways. We may collect Personal Information and Non-Personal Information directly from you or in the course of our dealings with you. For example, when you:
- download, access and use the Life I live App and our Services (including when you create a user profile or update your user profile on, or, via, the Life I live App);
- post, upload or publish memories, content, information and other data on, or via, the Life I live App or when you invite authorised users to access your user profile on the Life I live App;
- when you otherwise contact, interact or communicate with us (such as by telephone, email or in person) with a query or request or make a comment on our social media sites or lodge a complaint or on, or via, the Life I live App; and
- when otherwise legally authorised or required to do so.
- We may also collect Personal Information and Non-Personal Information about you from publicly available sources and third parties, including:
- when you provide your Personal Information to our Authorised Affiliates or other third parties; and
- if you use our social media sites or applications, pages or plugins or third party products or services that interact with the Life I live App and Services.
- When we collect Personal Information directly from you or from third parties, we will take reasonable steps to notify you (using a collection notice) at, before, or as soon as practicable after, the time of collection.
- By providing your Personal Information to us, you acknowledge that you are authorised to provide such information to us.
- How we use your Personal Information
- We only use, process and disclose your Personal Information for the purposes for which it is collected.
- In particular, we use, process and disclose your Personal Information and Non-Personal Information to:
- provide or deliver the Life I live App and Services to account holders and authorised users;
- assist with, or respond to, your queries or respond to, or investigate, complaints raised by you about the Life I live App and/or Services;
- inform you about the Life I live App, our Services or about offers, competitions, promotions, events, sweepstakes, surveys, questionnaires about us, the Life I live App and Services, or other matters which we believe are of interest to you (such as recruitment or job opportunities);
- manage, administer, improve, test, develop and upgrade the Life I live App and our Services, inform you about scheduled maintenance or outages and managing our relationship with you;
- share with our Authorised Affiliates;
- for internal record keeping;
- for direct marketing purposes (see below);
- comply with our legal and regulatory obligations;
- for any purpose to which you have consented; and
- for any other purpose notified to you at the time of collection.
- In the event of a merger, acquisition or sale of the whole or part of our business or assets, we reserve the right to transfer your Personal Information as part of the transaction, without your consent or notice to you.
- Disclosure to Authorised Affiliates
- In order to provide or deliver the Life I live App and our Services to you, we may disclose your Personal Information and Non-Personal Information to:
- our related bodies corporate, business partners, service providers, third party contractors, agents or suppliers;
- authorised external service providers who perform functions on our behalf, such as internet and technology services providers, app and website software developers, third party payment processors, hosting companies, marketing, security service providers, fulfilment companies, credit reporting agents, market research and recruitment service providers; and
- external business advisors, such as auditors, lawyers, insurers and financiers, (collectively, Authorised Affiliates).
- We may also disclose your Personal Information and Non-Personal Information:
- to any other party with your consent and direction;
- to law enforcement bodies or regulatory authorities to assist with their functions, or as otherwise required or authorised by law; or
- where we consider it necessary to comply with any applicable law, regulation, legal process, governmental request, or industry code or standard.
- This Privacy Policy only covers the use and disclosure of information we collect from you. The use of your Personal Information by any third party is governed by their privacy policies and is not within our control.
- When we disclose your Personal Information or Non-Personal Information to any of our Authorised Affiliates, we will ensure that they undertake reasonable steps to protect your privacy. These Authorised Affiliates are not permitted to use the information for any purpose other than the purpose for which they have been given access.
- Our Authorised Affiliates may also provide us with Personal Information and Non-Personal Information collected from you. If you disclose Personal Information to an Authorised Affiliates, we rely on you to provide the Authorised Affiliates with consent for us to collect, storage, use, process, alter and disclose your Personal Information.
- Overseas disclosure
- In the course of providing you with access to, and use of, the Life I live App, it may become necessary or desirable to disclose Personal Information to Authorised Affiliates located in Australia and overseas. The countries in which these overseas recipients may be located will depend upon the individual circumstances. However, in the course of our business, we may disclose your Personal Information and Non-Personal Information to our software developers who are based in the Philippines and Pakistan.
- The laws where these overseas recipients may be located provide various levels of protection for Personal Information which are not always equivalent to the level of protection that may be provided for in Australia. Where we transfer your Personal Information overseas, we will take reasonable steps to ensure that your Personal Information is treated securely, and the means of transfer provides adequate safeguards.
- By accessing or using the Life I live App and Services or providing your Personal Information to us, you explicitly and freely consent to the transfer of your Personal Information to our overseas Authorised Affiliates. If you do not wish to receive information from any of our Authorised Affiliates, please let us know using the details below. However, if you do not provide your Personal Information to us or our Authorised Affiliates, we may not be able to provide you with access to, and use of, the Life I live App and Services.
- Marketing communications
- We may use and disclose your Personal Information to send you information about the Life I live App and Services, or information about other products or services we (or third parties) may offer from time to time, as well as other information that may be of interest to you.
- If you do not wish to receive any of these marketing communications, you can opt out by following the unsubscribe instructions included in the relevant marketing communication, or by contacting us using the contact details set out in section 13 below.
- Notifiable Data Breaches Scheme
In the event of any loss, or unauthorised access or disclosure of your Personal Information that is likely to result in serious harm to you, we will investigate and notify you and the Australian Information Commissioner as soon as practicable, in accordance with the notifiable data breach scheme contained in Part IIIC of the Privacy Act.
- Security of your Personal Information
- We take reasonable steps in the circumstances to ensure that the Personal Information it holds is protected from misuse, interference, and loss, and unauthorised access, modification, or disclosure.
- The transmission of information via the Internet is not completely secure. We cannot guarantee the security of your data transmitted to our online services, and any transmission is at your own risk.
- We will destroy or de-identify Personal Information in circumstances where it is no longer required, unless we are otherwise required or authorised by law to retain the information.
- Accessing and correcting your Personal Information
- We take reasonable steps in the circumstances to ensure Personal Information we hold is accurate, up-to-date, complete, relevant, and not misleading. Under the Privacy Act, you have a right to access and seek correction of your Personal Information that is collected and held by us.
- If at any time you would like to access or correct the Personal Information we hold about you, or you would like more information about our approach to privacy, please contact us via the contact details set out in section 13 below. If we refuse your request to access or correct your Personal Information, we will provide you with written reasons for the refusal and details of complaint mechanisms.
- Cookies and analytics
- We use small text files placed on your computer called ‘cookies’ to collect standard log and visitor behaviour information in an anonymous form. We use this information to analyse how visitors use our website and to compile statistical reports on website activity. You can set your computer to reject cookies, but this may affect your ability to use certain parts of our website.
- Services that our website may use from time to time include Apple Analytics, which transmits website traffic data to Apple servers. Apple Analytics does not identify individual users or associate your IP address with any other data held by Apple. We use reports provided by Apple Analytics to help us understand traffic and usage on the Life I Live App. By using the Life I Live App, you consent to Apple processing your data in the manner described in Apple’s Privacy Policy (https://www.apple.com/legal/privacy/) and for the purposes set out in this Privacy Policy.
- Privacy complaints
- If you have any issues about this Privacy Policy or the way we handle your Personal Information, please contact us using the details below and provide full details of your complaint and any supporting documentation.
- At all times, privacy complaints:
- will be treated seriously;
- will be dealt with promptly;
- will be dealt with in a confidential manner; and
- will not affect your existing obligations or your commercial arrangements with us.
- Our Privacy Officer will endeavour to:
- respond to you within 10 business days; and
- investigate and attempt to resolve your concerns within 30 business days or any longer period necessary and notified to you by our Privacy Officer.
- If you are dissatisfied with the outcome of your complaint, you may refer the complaint to Office of the Australian Information Commissioner.
